2. The writ application has been preferred by the petitioner seeking directions upon the respondents restraining them from encroaching upon the land of the petitioners and stop the construction of road which is being constructed under the Mahatma Gandhi Rastriya Gramin Rojgar Gurantee Yojna from Main Road to Dih Brahamasthan.

3. Learned counsel for the petitioner has submitted

Patna High Court CWJC No.16193 of 2016(3) dt.28-07-2026 2/2 that as per the instructions the petitioners are living peacefully and there is no obstruction from the authorities and hence, he seeks that liberty is given if the authorities again proceed to take action against them.

4. Permission is accorded.

5. Liberty is granted to the petitioners to move application before the authorities in the event of eventuality or obstruction by them by making an application to Circle officer, Kateya, District- Gopalganj, under the provisions of Bihar Public Land Encroachment Act 1956, and Circle Officer shall examine the representation, pass necessary orders taking into consideration their ownership/title.
