Singh, learned counsel for the petitioner, and Smt. Sharda kumari, learned A.P.P. for the State. The petitioner in the present case is seeking regular bail in connection with Belhar P.S. Case No. 293/2015 registered for offences punishable under Sections 364/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner and the informant are 'Gotia' and a bare perusal of Annexure-4 would show that there was some dispute over a piece of land which was later on compromised and good understanding was reached between the parties which will be evident from Annexure-5 enclosed with this application. It is further submitted that the alleged victim boy has already come back without there being any sign of assault or injury on his body. The petitioner has
Patna High Court Cr.Misc. No.28023 of 2017 (3) dt.06-07-2017 2/2 no criminal antecedent and is in custody since 08.03.2017. Learned A.P.P. opposed the prayer for bail, however, significant material could not be placed to controvert the submissions.
In the facts and circumstances of the case, let the petitioner, namely, Arun Yadav, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Belhar P.S. Case No. 293/2015.
