The petitioner seeks regular bail in connection with Gaighat P.S. Case No. 34 of 2017, registered for the offence punishable under Sections 25(1-b) a/26/35 of the Arms Act. The allegation levelled, according to the F.I.R., is that an information was received by the police that two boys are roaming in village- Jarangdih with pistol and magazine, as such, a search team was decided to be constituted and the said two boys are said to have been apprehended, whereafter one pistol with magazine is said to have been recovered from possession of the petitioner. Learned counsel for the petitioner submits that the petitioner is innocent, the seizure list is antedated inasmuch as one of the seizure list witnesses has stated on affidavit that his

Patna High Court Cr.Misc. No.29024 of 2017 (2) dt.01-07-2017 2/2 signature was taken by the police on a blank paper and that the petitioner is in custody since 7.3.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Gaighat P.S.
