The petitioner apprehends his arrest in Fulkaha P.S. Case No. 29 of 2014, registered for the offences punishable under Section 308 and other Sections of the Indian Penal Code. The informant Subodh Kumar Yadav named the petitioner along with other accused persons and alleged that the accused persons were ploughing his lands. When it was objected by the informant on the ground that there was no partition, on the order of the petitioner the accused persons assaulted the informant and other family members of the informant. The petitioner is also alleged to have assaulted with Khanti. Proceedings under Section 107 and 144 of the Cr.P.C. are also going on. Learned counsel for the petitioner submits that there
Patna High Court Cr.Misc. No.4930 of 2015 (2) dt.04-02-2015 is a land dispute between the parties. The injuries are simple in nature. The injury found on Sangita, sister of the informant and the mother of the informant is simple in nature.
On considerations of the fact that on account of land dispute some scuffle took place and the informant and other persons got simple injuries, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri S.K. Mishra, the learned Judicial Magistrate, 1st Class, Araria in connection with Fulkaha P.S. Case No. 29 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
