The petitioner seeks regular bail in connection with Katihar Town P.S. Case No. 175 of 2017, registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and section 30(a) of Bihar Prohibition and Excise Act. The allegation is with regard to recovery of Mahua liquor from the tempo of the petitioner, upon the police having apprehended the tempo and conducted a search of the said tempo. Learned counsel for the petitioner submits that the petitioner has clean antecedent and he is in custody since 21.03.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Patna High Court Cr.Misc. No.29009 of 2017 (2) dt.01-07-2017 2/2 Accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Judge (Excise), Katihar in connection with Katihar Town P.S. Case No. 175 of 2017.
