JUSTICE PARTHA SARTHY ORAL ORDER 07-07-2020 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. The petitioner has filed the instant application for grant of anticipatory bail apprehending his arrest in connection with Dhanarua P.S. Case no. 220 of 2019 registered under sections 147, 148, 149, 324, 307, 427 and 379 of the Indian Penal Code.

As per allegation in the FIR, the seven named accused persons including the petitioner herein are stated to have assaulted the informant and to have looted various articles. It is further stated that the accused persons gave knife blow in the stomach of the informant causing injuries to him. It is submitted by learned counsel for the petitioner that the case of the petitioner stands on a similar footing to that of co-accused Bigan Yadav and Sudhir Kumar who have been enlarged on bail by order dated 20.11.2019 (Annexure 2) passed in Cr. Misc. no. 57614 of 2019 and to that of Lalu Kumar@Lallu Kumar who has been enlarged on bail by order dated 7.1.2020 (Annexure 3) passed in Cr. Misc. no. 85300 of 2019. It is further submitted that from perusal of the order granting bail it would transpire that no injury report is on record in the case diary. The petitioner has no criminal antecedent.

Having heard learned counsel for the parties and in the facts and circumstances of the case specially grant of bail to the co-accused, the Court is inclined to enlarge the petitioner on anticipatory bail. The petitioner is directed to surrender in the Court below within a period of eight weeks from today and in the event of his arrest or surrender in connection with Dhanarua P.S. Case no. 220 of 2019 he will be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Patna Civil Court, (Masaurhi) Patna subject to the condition as laid down under section 438(2) of the Cr.P.C.
