JUSTICE ARUN KUMAR ORAL ORDER 22-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with S.T. No. 369 of 2017 arising out of Samastipur Town P.S.Case No. 219 of 2017 registered under Sections 399,402 and 414/34 of the Indian penal Code.

Allegation in brief is that one stolen motorcycle was recovered from the possession of the petitioner. Learned counsel for the petitioner submits that motorcycle was not recovered from the conscious possession of the petitioner and he is in custody since 21.09.2017.

Whereas learned counsel for the State submits that stolen motorcycle was recovered from the conscious possession of the petitioner and he has four criminal antecedents of similar nature. Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.10362 of 2018 (2) dt.22-02-2018 2/2 the prayer for bail of the petitioner is rejected. However, petitioner may renew his prayer of bail if trail is not concluded within six months after framing of charge.
