JUSTICE SHIVAJI PANDEY ORAL ORDER 13-05-2020 Perused the records of this case and heard learned counsel for the State through virtual court proceeding. In the present case, the petitioner is seeking bail in Special Case No. 880 of 2020 arising out of P.R. Case No. 351 of 2020 registered for offence punishable under Sections 30 (a) and 56 (b) of Bihar Prohibition and Excise Act. As per allegation, about 50 liters of illegal liquor was recovered from the motorcycle of the petitioner, however, counsel for the petitioner submits that he is in judicial custody since 24.01.2020 having no criminal antecedent. Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on his personal bond due to the circumstance of total lock down

No.12915 of 2020(2) dt.13-05-2020 2/2 on account of pandemic Covid-19 to the satisfaction of Special Judge, Excise, Patna in connection with Special Case No. 880 of 2020 arising out of P.R. Case No. 351 of 2020 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
