2. This is 2nd anticipatory bail application on behalf of the petitioners. Earlier, the prayer for anticipatory bail was dismissed as withdrawn, vide order dated 15.12.2022 passed in Cr. Misc. No. 49764 of 2022 (Annexure - P/1 to the petition).

3. The petitioners have renewed their prayer for bail on the ground that after the rejection of their anticipatory bail petition, other co-accused persons namely Munni Lal Rai, Pradeep Kumar and Vikas Kumar & Aakash Kumar have been granted anticipatory bail by this Court, vide orders passed in Cr.Misc. Nos. 57029 of 2023, 69075 of 2023 and 78487 of 2023 respectively (Annexure P/4 series).

As per the prosecution story, upon hearing the decision of the Punches regarding partition of ancestral land, the petitioners and other F.I.R. named co-accused persons assaulted the informant and his father with deadly weapons, due to which, father of informant died. From perusal of paragraph - 3 of the petition, it appears that petitioners are accused in one more case.

5. Considering the nature of accusation and criminal antecedent of petitioners, their prayer for anticipatory bail is rejected.
