2. The petitioner is seeking regular bail in connection with Mithanpura P.S. Case No. 144 of 2023 for the offences punishable under Sections 366A of the IPC and Section 306, 376 of the IPC and Sections 4/6 of the POCSO Act and Section 3(i)(r)(s)(w)(ii)(v)(w), (va) of SC/ST Act.

3. The mother of the deceased states in her fardbeyan that her daughter, aged about 16 years, went to a temple with her friend Sabiya but did not return. When the informant contacted Sabiya, she was in an extreme state of fear and informed the informant that an unknown person had forcibly taken away the victim in a vehicle. The mobile phone of the victim was found to be switched off. Later, the Maharashtra Police informed the

The dead body of the victim was recovered by the Maharashtra Police in the room of the petitioner in hanging state. The room where the body was found was bolted from the inside.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the circumstances shows that the victim committed suicide. He has also submitted that the petitioner is a person of clean antecedents and is under custody since 24.05.2023

5. Learned APP for the State has opposed the prayer for bail and submitted that the deceased is a minor girl, aged 16 years, belonging to the Scheduled Castes. Her dead body was found in Maharashtra, hanging in the room of the petitioner. The petitioner had kidnapped the minor daughter of the informant.

6. Considering the above-mentioned facts and circumstances as well as the gravity of the allegation, I do not think it to be a fit case for bail, which is hereby rejected. (Nawneet Kumar Pandey, J) Nirmal/- U T
