JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner. No one appears on behalf of the State to assist the Court. The petitioner is accused in Kochas P.S.Case No. 108 of 2016 for the offense under Sections 406 and 420 of the Indian Penal Code.

The allegation against the petitioner is that he is running a chit fund Company and he has duped the informant who deposited heavy amount in the company of the petitioner. Later on when the informant demanded refund, the petitioner failed to refund the amount deposited by the informant. Counsel for the petitioner submits that the petitioner is not running chit fund company rather he runs cloths business. The petitioner is in custody since 14.10.2016.

No.9940 of 2017 (5) dt.20-07-2017 2/2 Considering the fact that the receipt on which the informant places reliance is a computer generated receipt and does not bear the signature of the petitioner as per the statement made in para-13 of the petition and the petitioner is in custody since 14.10.2016, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-1, Rohtas at Sasarm in connection with Kochas P.S. Case No. 108 of 2016, subject to the conditions that one of the bailors of the petitioner should be a local resident having substantial immovable properties within the jurisdiction of the court below and further that the petitioner will extend full cooperation in the conclusion of the trial and will not, in any manner, tamper with the evidence or influence the witnesses.
