Petitioner seeks bail in a case registered for the offences punishable under Sections 457, 380 and 427 of the Indian Penal Code.

Submission is that co-accused Bali Bhuiyan, son of Late Fakirchand Bhuiya has already been allowed bail by this Court vide order dated 23.02.2018 passed in Cr. Misc. No. 10640 of 2018 considering the fact that FIR of the occurrence of dacoity was against unknown. Petitioner was in custody since 30.07.2017. This petitioner is in custody since 08.09.2017. Investigation of the case is already complete.

Considering the aforesaid fact, let the petitioner,

Patna High Court Cr.Misc. No.19527 of 2018 (2) dt.10-04-2018 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Fatehpur Police Station Case No. 251 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
