JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Bathnaha P.S. Case no. 254 of 2019, registered under Section 30(a)(c) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on receiving the information about selling of liquor by Sukhari Paswan in his house in village-Bathnaha, the informant along with other Police personnel reached there. On search of house of petitioner, 60 bottles, each containing 300 ML Nepali liquor recovered. In course of raid, three persons were present there, who disclosed their names Mukesh Paswan, Arun Paswan and Bhola Sada. Learned counsel for the petitioner submits that petitioner was not apprehended on the spot and room of house,

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant pre-arrest bail to the petitioner. Accordingly, his prayer for grant of pre-arrest bail stands rejected. The petitioner is directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
