No one appears for State.

The petitioner in the present case is seeking regular bail in Sheohar P.S. Case No. 58 of 2017 under Sections 30(A) and 38 of the Bihar Excise and Prohibition Act, 2016. Learned Senior Counsel for the petitioner submits that from a bare perusal of the First Information Report it would appear that the alleged seizure has been made from the house of one Chandan Kumar, however, on the confessional statement of said Chandan Kumar, name of the present petitioner has also been implicated in the present case. Learned Senior Counsel has further drawn my attention towards paragraph 3 of the application

Patna High Court Cr.Misc. No.27489 of 2017 (2) dt.01-07-2017 2/2 wherein it is stated that in the same set of alleged occurrence, another case being Shyampur Bhatha P.S. Case No. 33/2017 has been registered. He would further submit that in the said case the petitioner has been granted regular bail in Cr. Misc. No. 27924/2017 by a co-ordinate bench of this Court. The petitioner is in custody since 23.04.2017.

Considering the facts and circumstances of the case as also that a co-ordinate bench of this Court has granted regular bail to the petitioner in another case, which arises of the same alleged occurrence, let the petitioner, namely, Madhurendra Singh @ Madhurendra Kumar Singh @ Chunnu Singh be enlarged on bail on his furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge cum Special Judge, Sheohar in Sheohar P.S. Case No. 58 of 2017, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
