JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner, in the present case, is seeking regular bail in connection with Piro (Hasan Bazar O.P.) P.S. Case No. 85 of 2017, registered for the offences punishable under Sections 379, 411, 414 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is one of the three named accused in the First Information Report who were allegedly apprehended by police. The co-accused Mantosh Kumar who was also arrested alongwith this petitioner has been granted regular bail by Co-ordinate Bench of this Court vide Cr. Misc. No. 31385 of 2017. Further, one of the accused Manish who is said to be a purchaser and from whom the motorcycle was

Patna High Court Cr.Misc. No.32813 of 2017 (2) dt.20-07-2017 2/2 recovered has been granted regular bail vide Criminal Misc. No. 25897 of 2017. However, Learned A.P.P. for the State opposes the prayer for bail but could not deny that the petitioner is similarly situated.

In the facts and circumstances of the case, let the petitioner, above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Piro (Hasan Bazar O.P.) P.S. Case No. 85 of 2017, subject to the condition under Section 437(3) of the Cr.P.C.
