Petitioners, already in custody, seek bail in connection with Sikandra P.S. Case No.45 of 2017, registered under Sections 323, 341, 307, 34 and 302 of the Indian Penal Code. Allegation in brief is that the petitioners indiscriminately assaulted with lathi, danda and iron rod to the informant's father as a result of which he became badly injured and succumbed to the injury.

Submission is that there is general and omnibus allegation against the petitioners, the post-mortem report clearly reveals that no external injury was found on the person of the deceased rather he died due to cardiac arrest, this case was lodged after

Patna High Court Cr.Misc. No.8366 of 2018(2) dt.12-02-2018 2/2 delay of four days, petitioners have no criminal antecedent and one co-accused, similarly situated, has been admitted to bail by a coordinate Bench of this Court by order dated 06.02.2018, passed in Cr. Misc. No.1492 of 2018.

Having considered the said facts and circumstances, petitioners Pramod Sharma @ Pramod Mistri and Vivek Sharma @ Dinesh Sharma are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Jamui in connection with Sikandra P.S. Case No.45 of 2017.
