The petitioner seeks bail in anticipation of his arrest in connection with Kuchaikot P.S. Case No. 244 of 2020, dated 29.06.2020, instituted for the offences under Sections 302/34 of the Indian Penal Code.

The son of the informant had left for his aunt's house but never returned. Later, his dead-body was found behind the showroom of Tata Motors. The name of the

Patna High Court CR. MISC. No.24128 of 2021(3) dt.09-02-2022 2/3 petitioner has been suspected in this case only on the ground that shortly before the occurrence, ten persons including the petitioner had threatened the informant that her son would be eliminated.

It has been submitted on behalf of the petitioner that beyond the aforesaid statement of the informant, there is no other material to connect the petitioner with the offence.

It has further been submitted that under similar circumstances, one of the co-accused persons, namely, Mogal Yadav @ Mugal Yadav has been granted anticipatory bail by this Court vide order dated 27.09.2021 passed in Cr. Misc. No. 711 of 2021.

The petitioner does not have criminal antecedents. Regard being had to the facts afore-stated as also grant of anticipatory bail to one of the similarly situated coaccused persons referred to above, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of

Patna High Court CR. MISC. No.24128 of 2021(3) dt.09-02-2022 3/3 Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Chief Judicial Magistrate, Gopalganj in connection with Kuchaikot P.S. Case No. 244 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
