The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
Diary in this case was called for earlier which has since been received.
Learned counsel for the petitioners submits that the marriage of the petitioners' son with the deceased took place and thereafter he separated from the petitioners. The petitioners being father-in-law and mother-in-law of the deceased have separated in mess and residence and had no concern with the affairs of their
Patna High Court Cr.Misc. No.18306 of 2016 (3) dt.21-06-2016 P2/2 son.
Learned counsel appearing on behalf of the State after perusal of the case dairy submits that there is no independent witness to support the allegations of the informant. Rather, it has come on record that the parents of the main accused (husband of the deceased) were living separately and, therefore, they had no concern with the deceased and her husband.
Considering the aforementioned facts and circumstances and there being no cogent material in the case diary, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran in connection with Darpa P.S. Case No. 90/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
