The petitioner seeks bail in connection with Pusa P.S. Case No. 127 of 2024 instituted for the offence under Sections 303(1), 317(2), 318(2), 336(3), 338 & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

Prosecution case in short is that police on a tip off regarding one stolen pickup one coming towards Birauli, started vehicle checking and intercepted one pickup van and
Patna High Court CR. MISC. No.13150 of 2025(2) dt.06-03-2025 2/3 arrested the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26-11-2024. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner was driving the pickup vehicle and nothing incriminating is recovered from the conscious possession of the petitioner. In fact, petitioner has no knowledge that the number plate of the seized pickup van was changed. It is submitted that pickup van is not stolen one rather one Mithilesh Singh is the legal owner of the same who handed over the vehicle to petitioner for some transportation work. Charge sheet is submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.
Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, clean antecedent of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on
Patna High Court CR. MISC. No.13150 of 2025(2) dt.06-03-2025 3/3 furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Pusa P.S. Case No. 127 of 2024.
