The petitioner is apprehending his arrest in connection with Doriganj P.S.Cae No.249 of 2017 registered for offences punishable under Sections 147, 148, 149, 188, 341, 383, 352, 332, 333, 307 and 120(B) of the Indian Penal Code. Allegation against the petitioner and the other accused persons is of assaulting the police party and he has criminal antecedent also.
Submission of the learned counsel for the petitioner is that no specific allegation has been attributed and all the case have been lodged in the near future by the police and he is on bail in all the cases.
Heard learned A.P.P. also, who has opposed the prayer for
Patna High Court Cr.Misc. No.20185 of 2018 (2) dt.11-04-2018 2/2 bail.
Having heard both sides and in view of criminal antecedent of the petitioner, I am not inclined to grant anticipatory bail to the petitioner rather the petitioner surrender before the learned court blow within a period of four weeks from the date of receipt of this order and make prayer for regular bail, which will be considered on its own merit without being prejudiced by the order of this Court and also considering the fact that he is on bail in other cases. With the aforesaid observation, this application is disposed of.
