The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 379, 307 and 504/34 of the Indian Penal Code.
The specific accusation of causing injury on the head of the informant by Bakua is against petitioner no. 1 Kabool Mian. The occurrence took place in the background of fight between the children of both sides.
Let the learned court below consider prayer for regular bail of petitioner no. 1 Kabool Mian if he surrenders within a period of six weeks from the date of receipt/production of copy of the order in
Patna High Court Cr.Misc. No.5836 of 2015 (2) dt.03-03-2015 2 / 2 connection with Valmiki Nagar P.S. Case No. 46 of 2014 pending in the court of the learned A.C.J.M. Bagaha, West Champaran.
With this observation, the application of petitioner no. 1 is disposed off.
So far petitioner nos. 2 to 4 are concerned, accusation of assault is not against them and a statement made in paragraph no. 3 of the petition that the petitioners have no criminal antecedent, let them except petitioner no. 1 above named be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Valmiki Nagar P.S. Case No. 46 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Bagaha, West Champaran, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
