The petitioner seeks bail in Obra P.S. Case No.211 of 2017 registered under Section 30 (a), 37 (b) and 38 (1) of the Bihar Prohibition and Excise Act, 2016.
300 liters of country made liquor is said to have been recovered from the Alto car of the petitioner and the petitioner who was standing outside of car was apprehended in course of escaping.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has been falsely implicated in this case. He has no concern either with the
Patna High Court Cr.Misc. No.20207 of 2018 (02) dt.11-04-2018 2/ 2 seized liquor or with the car from where the aforesaid liquor is said to have been seized. He has been languishing in custody since 18.01.2018. The driver of the said car, namely, Akhilesh Yadav has been granted bail by a coordinate Bench of this Court in Cr. Misc. No.13598 of 2018 vide order dated 08.03.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-VIIcum-Special Judge, Aurangabad in connection with Obra P.S. Case No.211 of 2017.
