Petitioner seeks bail in a case registered for the offences punishable under Sections 364, 34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.

The FIR was lodged on missing of the husband of the informant. Suspicion was raised that the petitioner and others have abducted and committed the murder. After recovery of dead body, the petitioner was arrested.

Submission is that the case diary would reveal that only material is suspicion. Investigation is already complete now. Petitioner is ready to cooperate with the trial. Learned counsel for the informant opposed the prayer for bail.

Patna High Court Cr.Misc. No.9372 of 2018 (3) dt.28-03-2018 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dhaka Police Station Case No.120 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
