JUSTICE KHATIM REZA ORAL ORDER 02-04-2025 Learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application of Petitioner No. 1, namely, Parshuram Manjhi @ Parshuram Kumar, who has been arrested during pendency of this case.

2. Considering the aforesaid facts and circumstances of the case, the anticipatory bail application is dismissed as withdrawn so far as it relates to Petitioner No. 1, namely, Parshuram Manjhi @ Parshuram Kumar.

3. Now the anticipatory bail application is only confined to petitioner no. 2 namely, Reshmi Devi.

4. The petitioner no. 2 apprehends arrest in connection with Paliganj P.S. Case No. 405 of 2024 dated 08.10.2024,

Patna High Court CR. MISC. No.13071 of 2025(2) dt.02-04-2025 2/3 instituted for the offence punishable under Sections 191(2), 191(3), 190, 126, 115(2), 109, 121, 132, 62(2), 352 of the B.N.S. and Section 30(a), 45 of the Bihar Prohibition and Excise Act, 2022.

5. The prosecution case, in brief, is that on 08.10.2024, the police received a secret information that Parshuram Manjhi (petitioner no. 1) is selling liquor from his house. To verify the same, the police reached at the house of Parshuram Manjhi where they saw a lady and a gents managed to escape from seeing the police and on search 2000 litres of jaggery, mahua and raw liquor was recovered and destroyed by the police at the spot and 3 litres of illicit country made liquor was recovered.

6. Learned counsel for the petitioner submits that the petitioner no. 2 is innocent and she has been falsely implicated in this case. It is further submitted that petitioner no. 2 being mother of petitioner no. 1 namely, Parshuram Manjhi @ Parshuram Kumar has been falsely implicated in this case. It is also submitted that nothing has been recovered either from the conscious possession or from the house of the petitioner no. 2. Lastly, it has been submitted that petitioner no. 2 has no criminal antecedents.

7. Learned A.P.P. has opposed the prayer for bail of the petitioner.

8. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner no. 2 within a period of six weeks from today, in connection with Paliganj P.S. Case No. 405 of 2024, she shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special, Excise Judge, Danapur, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Khatim Reza, J) sankalp/- U T
