The petitioner seeks bail in Pandarak P.S. Case No. 128 of 2016 registered under Sections 302 and 34 of the Indian Penal Code.
The petitioner along with other accused are said to have brutally assaulted the son of the informant resulting into his death for committing theft of Rs. 8200/-.
It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. He has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. As a matter of fact, the deceased was assaulted
Patna High Court Cr.Misc. No.29385 of 2017 (2) dt.01-07-2017 2/2 by the villagers suspecting him to be thief. The petitioner has been languishing in custody since 27.03.2017. It is further submitted by the petitioner that the chargesheet in the case has been submitted. Considering the facts and circumstances and the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on bail at this stage. Accordingly, the same is rejected. The petitioner may be at liberty to renew his prayer for bail after completion of six months in custody or after framing of charge whichever happens earlier.
