JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Hulasganj P.S. Case No. 95 of 2013 registered for the offences punishable under Sections 147, 148, 149, 324, 307, 379 of the Indian Penal Code.

Although, there is accusation against the petitioner that he gave farsa blow on the head of the informant but simple injury was found on the person of the informant said to be caused by sharp cutting weapon. Moreover, after due investigation, police found the accusation untrue against the petitioner and submitted charge sheet against the other accused for bailable offences. The learned Chief Judicial Magistrate differed with the findings of the police and took the cognizance of the offences under Section 307

Patna High Court Cr.Misc. No.3273 of 2015 (2) dt.23-01-2015 and other minor sections of the Indian Penal Code against the charge sheeted accused as well as this petitioner also. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in Hulasganj P.S. Case No. 95 of 2013 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
