2. The petitioner seeks bail in connection with Korha P.S. Case No.-364 of 2023 registered for the offence under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, it is a case of shot firing upon the informant with intention to kill him by the accused persons.

Learned counsel for the petitioner has submitted that petitioner has falsely been implicated in this case. He next submits that the petitioner is suffering from his heart diseases and is continuing under treatment since 2018 as stated in

Patna High Court CR. MISC. No.16934 of 2024(2) dt.21-03-2024 2/2 para-12 of the petition and the name of the petitioner surfaced on the basis of the confessional statement of co-accused Rahul Kumar Paswan and he is in custody since 23.09.2023. Similarly situated co-accused has already been granted bail by this Court passed in Cr. Misc. No. 15902 of 2024.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances of the case, let the petitioner, above named, be directed to be released on bail in connection with Korha P.S. Case No.364 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar.
