JUSTICE SUDHIR SINGH ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 147, 148, 149, 323, 324, 332, 186, 307, 353, 379, 511 and 504 of the Indian Penal Code and 3/4/5 of BMMC Rule.
Allegation against the petitioner is that he along with other accused persons attacked the police party, tried to snatch their rifles and assaulted them as a result of which police persons sustained injuries and fell down.
It is submitted on behalf of the petitioner that petitioner has falsely been implicated in the present case. Petitioner is said to be the order giver. No specific injury has been attributed against the petitioner. The main allegation of assault is against Pappu Yadav, Soni Kumar, Shalock Rajbanshi and Ashok Bhuiyan.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the
Patna High Court Cr.Misc. No.15655 of 2016 (2) dt.03-05-2016 2/2 court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Rajauli P.S. Case no. 245 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
