02-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Sherghati P.S. Case No. 84/2017 registered for the offence punishable under Sections 394 of the Indian Penal Code.

Learned counsel for the petitioner submits that in the present case petitioner is not named in the F.I.R. Nothing has been recovered from his possession. He has not been identified till date. Learned counsel further submits that the co-accused Rizwan @ Rizwan Khan @ Rizu has been granted privilege of bail by co-ordinate Bench of this Court vide Cr. Misc. No. 2689/2018. There are two cases against this petitioner and in both of them he is on bail.

Patna High Court Cr.Misc. No.4963 of 2018 (2) dt.02-02-2018 Learned Additional Public Prosecutor for the State opposes the prayer for bail of the petitioner. Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sherghati, Gaya, in connection with Sherghati P.S. Case No. 84/2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
