JUSTICE SANJAY PRIYA ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner and the State. Petitioners seek bail in Ghoshwari P.S. Case No. 43 of 2016 corresponding to Sessions Trial No. 342 of 2017 instituted for the offence under Sections-395, 412 of the Indian Penal Code. It has been submitted that the FIR has been lodged against unknown. It is alleged in the written report that tractor of the informant has been looted. The informant made search for his tractor and the informant could not be able to trace the tractor and the driver. In course of search, when he reached near small bridge in the middle of big bridge, he found his driver tied with rope and his driver disclosed the name of one Bhima, who caused the occurrence. The seizure list has been enclosed with this petition from perusal of which, it appears that the alleged tractor has not
Patna High Court Cr.Misc. No.31333 of 2017 (2) dt.12-07-2017 2/2 been recovered from possession of the petitioner and the seizure list does not bear signature of the petitioner. The learned Sessions Judge referring paragraph-7 of the C.D. has mentioned in the impugned order that the tractor has been recovered from possession of the petitioner but paragraph-7 of the C.D. does not corroborate the seizure list. The petitioner is said to be in custody since 17-06-2016.
In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ghoshwari P.S. Case No. 43 of 2016 corresponding to Sessions Trial No. 342 of 2017 to the satisfaction of learned Additional District & Sessions Judge-III, Barh, Patna subject to condition that both the bailors should be close relatives of the petitioner.
