Petitioner, already in custody, seeks bail in connection with Fatuha P.S. Case No.480 of 2017, registered under Sections 406 and 420 of the Indian Penal Code.
Allegation in brief is that the petitioner received Rs.6,95,000/- as consideration money from the informant to sale a piece of land in his favour but later on refused to execute the sale deed.
Learned counsel for the petitioner submits that there was no agreement and it is alleged that the money was given in cash but there is no transaction by any instrument moreover the document of panchayati is a forged document and the petitioner is in custody since 05.12.2017, at best it may be a case of civil
Patna High Court Cr.Misc. No.16479 of 2018(2) dt.22-03-2018 2/2 nature and the petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, petitioner Madhusudan Prasad is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City in connection with Fatuha P.S. Case No.480 of 2017.
