The petitioners apprehend their arrest in a case registered under Sections 323, 324, 354, 452, 504, 506/34 of the Indian Penal Code and Sections 3(i) (ii) 3 (i) (iii) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. The informant alleged that at about 11:30 P.M. on 17.08.2014, the accused persons came and assaulted the informant and others in the night.
It is submitted that the occurrence had taken place on 17.08.2014 but the information was given to the police on 18.08.2014. The First Information Report was lodged on 19.08.2014 i.e. after two days of the occurrence. The occurrence took place inside the house. Now the case has been compromised.
Patna High Court Cr.Misc. No.3162 of 2015 (2) dt.22-01-2015 Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj S.C. & S.T. P.S. Case No. 48 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
