JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-01-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 2157 of 2013 registered for the offence under Sections-498A, 406 of the Indian Penal Code and Section-3/4 of Dowry Prohibition Act.

The petitioner happens to be husband of the complainant and it appears that serious allegation has been levelled against him and, therefore, I am not inclined to grant anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Complaint Case No. 2517 of 2013, pending in the court of learned Sub Divisional Judicial Magistrate, Siwan stands rejected.

However, if, the petitioner surrenders in the court below

Patna High Court Cr.Misc. No.3936 of 2015 (2) dt.29-01-2015 and seeks regular bail, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
