JUSTICE ARUN KUMAR ORAL ORDER 15-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Murliganj PS Case No. 86 of 2017 registered under Sections 302/34 of the IPC. The allegation in brief is that the petitioner called the deceased to her house by calling him on phone and thereafter Bimlesh and others assaulted and the dead body was thrown in the field.

Learned Counsel for the petitioner submits that the informant is not the eye witness, during investigation also statement of any eye witness to the occurrence is not recorded and merely on suspicion the petitioner has been implicated in this case who is in custody since 20.4.2017.

Having considered the said facts and circumstances, the petitioner, namely, Duro Devi @ Duriya Devi is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Madhepura in connection with Murliganj PS Case No. 86 of 2017.
