The petitioner seeks bail in Special N.D.P.S. Case No. 16 of 2018 arising out of C.I. No. 538 of 2018, instituted for the offence under Section(s) 20(B) of the N.D.P.S. Act. It is alleged in the written report that 25 Kg of Ganja has been recovered from the room situated behind the tea shop of the petitioner.

Counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that from the written report it appears that total four persons including petitioner were present in the tea shop. They were packing Ganja in plastic pouches as mentioned in detail in prosecution

The other accused who were alleged to be present in the tea shop have already been granted bail by this Court vide orders dated 11.1.2019 and 20.2.2019 passed in Cr. Misc. 79863 of 2018 and 10162 of 2019 respectively. Petitioner is in custody since 15.9.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-VI-cum-Special (N.D.P.S. Act), Katihar, in connection with Special N.D.P.S. Case No. 16 of 2018 arising out of C.I. No. 538 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
