====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 17-11-2021 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in connection Runnisaidpur P.S. Case no. 15 of 2021 registered for the offence punishable under section 30(a) of Bihar Prohibition and Excise Act. Learned counsel for the petitioners submits that the petitioners are in custody since 05.01.2021 and charge sheet has been submitted and petitioners are persons with clean antecedent. He next submits that from perusal of the allegation as alleged in the FIR, it would manifest that 92.350 liter foreign liquor was recovered.

Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioners are in jail

Patna High Court CR. MISC. No.24213 of 2021(2) dt.17-11-2021 2/2 custody since 05.01.2021 and charge sheet has been submitted, petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ II-cum- Special Judge, Excise Act, Sitamarhi in Runnisaidpur P.S. Case no. 15 of 2021.
