JUSTICE BIRENDRA KUMAR ORAL ORDER 31-01-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Section 30(a) of the Excise Act. Ninety liters of country made liquor was allegedly recovered from the possession of the petitioner and petitioner. Petitioners are in custody since 21.11.2017. Petitioners have stated on oath that they have got no criminal antecedent. Considering the entire facts aforesaid, let the petitioners, above named, on completion of three months of custody, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the

Patna High Court Cr.Misc. No.5191 of 2018 (2) dt.31-01-2018 case is pending in connection with Rajauli Police Station Case No.358 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
