The present application has been filed for modification of the order dated 06.12.2022 passed in Cr. Misc. No. 22064 of 2022.

It is submitted by learned counsel for the petitioner that vide order dated 06.12.2022, the petitioner was granted bail and he was also directed to deposit Rs. 4000/- per month to the informant as

Patna High Court CR. MISC. No.18302 of 2023(3) dt.13-10-2023 2/3 maintenance and the informant was also directed to provide her bank account details to the petitioner. The bail bonds of the petitioner was to be accepted by the Court below on showing deposit of receipt of Rs. 4000/- in the account of the informant.

It is further submitted by learned counsel for the petitioner that the informant could not provide the bank details to the petitioner, hence, the petitioner had not paid the maintenance amount as directed by this Hon'ble Court. However, the petitioner, after receiving the bank details of the informant, has already paid 50 percent of the arrears amount i.e. 18,000/- in the account of the informant and for rest amount of Rs. 18,000/-, he undertakes to deposit the same in the account of the informant within a period of one month. The petitioner further undertakes to deposit Rs. 4,000/- per month to the informant in her bank account as maintenance.

Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.18302 of 2023(3) dt.13-10-2023 3/3 informant does not controvert this fact and submitted that informant has received Rs. 18,000/-.

Considering the facts aforesaid, the order dated 06.12.2022 passed in Cr. Misc. No. 22064 of 2022 is modified to the extent that period of surrender of the petitioner is extended for a further period of four weeks from today.

The Court below is directed to accept the bail bonds of the petitioner on his showing deposit of rest of the arrears amount of Rs. 18,000/- in the account of the informant.

The petition stands allowed.
