JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-03-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 379, 404 and 506 of the Indian Penal Code.

The prosecution case is that the informant being a SubInspector of police and others went to the village of the petitioners for making certain enquiries when the mob attacked the police force.

It is submitted by learned counsel for the petitioners that the police in order to save his own skin, lodged the present frivolous case. In fact one Anita Devi wife of petitioner no.1,

No.10839 of 2016 (2) dt.15-03-2016 2/2 Balindra Gond has illicit relationship with the A.S.I., Rajendra Pandit since petitioner no.1 used to reside outside the state and the same was protested by the villagers, hence the present case has been lodged. It is further submitted that the accusation and omnibus and general against the mob. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Siwan in connection with Guthani P.S. Case No. 172 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
