01-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner, in the present case, is seeking regular bail in connection with Nauhatta P.S. Case No. 12/2017 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 308, 379, 452, 379, 354, 504, 506 of the Indian Penal Code.
Learned counsel for the petitioner submits that from bare perusal of the First Information Report would show that there is no allegation of assault against the present petitioner. The allegation is specifically attributed to one Md. Kadir..
However, learned A.P.P. for the State
Patna High Court Cr.Misc. No.27529 of 2017 (2) dt.01-07-2017 opposes the prayer for bail of the petitioner, however, accepts the factual position in the F.I.R.
Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Saharsa in connection with Nauhatta P.S. Case No. 12/2017, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
