ANJANA MISHRA ORAL ORDER 01-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 22.7.2017 in connection with Baisi P.S. Case No.150 of 2017 registered for the offence under Section 414 of the Indian Penal Code and Sections 25(1-b)a/26 of the Arms Act.

Learned counsel for the petitioner submits that the alleged recovery of motorcycle was not made from the conscious possession of the petitioner, rather it was seized from the road side and when the petitioner, who was taking meal in a Hotel, was going away, he was taken into custody by the police. He further submits that the petitioner was not placed on T.I. Parade.

Case No.150 of 2017.
