JUSTICE VIKASH JAIN ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 23-03-2015 The grievance of the petitioner is that though the work of construction of drainage (Nala) from Shyamal Hospital to Mushari Tola has commenced in the year 2010, it has not been completed so far and the same is resulted into serious problems to the residents of the area.

It is stated that out of total length of 550 meters, work of construction to the extent of 537 meters was completed and rest 13 meters would be completed within fifteen days. Heard Sri Sanjeev Kumar Mishra, learned counsel for the petitioner, Sri Deepak Sahay Jamuar, AC to AAG No. 6 for the State, Sri Prasoon Sinha, learned counsel for the Patna Municipal Corporation and Sri Indrajeet Singh, learned counsel for the Bihar Rajya Jal Parishad.

Several reasons have been stated for not completing the construction work of the drainage within the stipulated time. Whatever may be the reasons, the fact remains that almost the entire construction works have been completed and the respondents have undertaken to complete the left over work, a small fraction of work, within fifteen days.

We, therefore, dispose of the writ petition by taking on record the undertaking of the respondents for completion of the left over work. There shall be no order as to costs. The interlocutory application, if any, stands disposed of. (L. Narasimha Reddy, CJ) (Vikash Jain, J) U B.T/-
