The petitioner wants to renew the prayer of bail which was earlier twice rejected vide order dated 07.04.2016 and 29.03.2017 passed in Cri. Misc. No. 5369 of 2016 and Cr. Misc. No. 9025 of 2017, on the ground that the petitioner is suffering in custody since 10.10.2015, there is case and counter case, up till now only eight prosecution witnesses have been examined out of total 11 chargesheeted witnesses and trial has not been concluded though there was direction to conclude the trial within nine months after commitment and, as such, the petitioner deserves sympathetic consideration.

Patna High Court Cr.Misc. No.23561 of 2018(2) dt.18-04-2018 2/2 The learned A.P.P. opposes the prayer of bail by submitting that trial is in progress and the petitioner is the assailant.

In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected in connection with Sessions Trail No. 88 of 2012 arising out of Barauni (Refinery) P.S. Case No. 209 of 2011 pending in the court of learned Additional District and Sessions Judge-1st, Begusarai.

However, considering the detention of the petitioner, the trial court is again directed to conclude the trial as early as possible preferably within six months from the date of receipt/production of a copy of this order after taking the same on priority basis.
