JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,324,307,379,323,506 and 120B/34 of the Indian Penal Code. It is alleged that the petitioner Md. Tauhid assaulted with knife to the informant on head. Petitioner Md. Mushin tried to strangulate the informant and Md. Khalik snatched rupees four thousand.

It is submitted by learned counsel for the petitioners that the injury report reflects one abrasion on the forehead, one laceration of marginal size and the other abrasion on the middle of the neck. It is further submitted that none of the injuries were caused by knife. There is counter version of the occurrence also.

Patna High Court Cr.Misc. No.3848 of 2015 (2) dt.29-01-2015 2/2 Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Sheikhpura in connection with Ariari (Mahuli) P.S. Case No. 58 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
