The petitioner in the present case is seeking regular bail in connection with Brahmpura P.S. Case No. 51 of 2017, registered for offences alleged under Sections 406, 420, 120(B)/34 of the Indian Penal Code read with Sections 3 / 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the allegation against the petitioner is that after negotiation of marriage with the daughter of the informant he demanded dowry and because the informant could not give the alleged dowry, the

Patna High Court Cr.Misc. No.31936 of 2017 (2) dt.20-07-2017 2/2 marriage was broken. The petitioner is in custody since 09.05.2017. Learned counsel submits that the allegations against the petitioner, who is the father of the boy with whom the alleged marriage was fixed, are false and flimsy and the petitioner was arrested without there being any preliminary investigation on this point.

Learned counsel for the informant opposed the prayer for bail and submitted that the petitioner having received some money and gifts refused to go for marriage which was fixed with his son and daughter of the informant.

Considering the nature of allegations, let the petitioner, namely, Naresh Verma @ Naresh Shankar Prasad be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Brahmpura P.S. Case No. 51 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
