JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2019 This is an application for grant of anticipatory bail in connection with Ram Nagar P.S. Case No. 258 of 2015, disclosing offences under Sections 147, 149, 323, 307, 379, 504 of the Indian Penal Code.

Allegation against the petitioners and other accused persons is of assault to the informant and there is specific allegation against one Akhilesh Yadav of assault by rod on his head causing injury.

Submission of learned counsel for the petitioners is that there is general and omnibus allegation against the

Patna High Court CR. MISC. No.13874 of 2019(2) dt.06-03-2019 2/2 petitioners and the specific allegation of assault by rod is against co-accused Akhilesh Yadav and injuries are simple in nature, which will appear from Annexure-2.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bagaha, West Champaran, in connection with Ram Nagar P.S. Case No. 258 of 2015, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
