The petitioner apprehends his arrest in Complaint Case No. 863/2013 registered under Sections 420, 406, 323, 341 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

The complainant alleged that he negotiated for marriage of his sister Gyanti Devi. The complainant gave Rs. 50,000/- to the petitioner, who is the father of the bride-groom, but the petitioner and other family members began to demand additional dowry.

Learned counsel for the petitioner submits that all the allegations are false. No chit of paper has been brought on record showing that the petitioner received any money. The case has been

Patna High Court Cr.Misc. No.4358 of 2015 (2) dt.02-02-2015 2/2 lodged just to put pressure for marriage of the son of the petitioner.

Considering the fact that no chit of paper is shown that the petitioner received any amount in dowry, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in Complaint Case No. 863/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
