This application for regular bail arises out of Laukaha (Lalmaniya) P.S. Case No. 207 of 2020, disclosing offence punishable under Sections 413, 414, 420, 467, 468, 34 of the Indian Penal Code.

The petitioner is in custody since 24.08.2020. A police officer is the informant. It is the prosecution's case that on the basis of a secret information to the effect that some miscreants had assembled for committing some crime, a raid was conducted. On seeing the police party, the miscreants fled away. Allegedly, police noticed a number plate of a Bolero

Patna High Court CR. MISC. No.23735 of 2021(3) dt.29-11-2021 2/2 vehicle displaying designation of Circle Officer. The police are said to have recovered 3 four wheelers and 1 Pulsar Motorcycle. Learned counsel appearing on behalf of the petitioner has submitted that the motorcycle recovered from the petitioner's possession cannot be said to be stolen one. He has further submitted that prior to registration of present FIR, the petitioner was not made accused in any other case. Considering the aforesaid submission and the fact that the petitioner is in custody since 24.08.2020, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned J.M. 1st Class, Jhanjharpur in Laukaha (Lalmaniya) P.S. Case No. 207 of 2020.
