2. The petitioner seeks regular bail in a case registered for the offence under Section 414 of the Indian Penal Code and Section 25(1-b)a, 26/35 of the Arms Act.

3. As per the prosecution case, one country made pistol, one cartridge and one motorcycle has recovered from the petitioner.

4. Learned counsel for the petitioner submits that nothing incriminating has been recovered from the possession of the petitioner and he is in custody since 19.10.2023.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur/concerned Court below in connection with Sadar(Hajipur) P.S. Case No. 783 of 2023 subject to condition that:- 7(i). The petitioner will mark his attendance at the Sadar Police Station Hajipur on the first and third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

7(ii). The petitioner will produce the documents about the ownership of the motorcycle. If the petition is found to be the owner of the motorcycle then his bail bond shall not be accepted.
