====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-05-2025 Learned counsel for the petitioner is directed to make necessary correction in the prayer portion of the bail petition in course of the day.
2. Heard learned counsel for the petitioner as well as learned APP for the State.
3. In this case, the petitioner is seeking regular bail in connection with Goh P.S. Case No. 357 of 2024, registered for the offences punishable under Sections 25(1-b)a and 26 of the Arms Act.
4. As per allegation, three country made pistols and 37 live cartridges were recovered from the bag of grains which is kept near the door of the house of the petitioner.
5. Learned Senior counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. He is under incarceration since
Patna High Court CR. MISC. No.13710 of 2025(3) dt.12-05-2025 2/2 09.12.2024. It has also been submitted that the cases mentioned in paragraph-3 of the bail petition, the petitioner has been acquitted in Goh P.S. Case No. 83 of 1992 and so far as two other cases are concerned in which he is on bail. It has further been submitted that the petitioner and his brother are at inimical terms regarding property disputes and Panchayat election. It has been submitted further that at the instance of his brother, the petitioner has been made accused.
6. On the other hand, learned APP for the State opposes the prayer for bail of the petitioner.

Considering the above-mentioned facts and circumstances as well as period of incarceration, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Daudnagar, Aurangabad in connection with Goh P.S. Case No. 357 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
